Purchase terms

These purchase–sale terms and conditions (hereinafter – the Terms) set out the procedures and conditions for purchasing, payment, delivery, returns, and other related matters in the online store www.emberspell.lt, operated by MB ED Shop (hereinafter – the Seller). The Terms also regulate the rights, duties, and responsibilities of both the Seller and the Buyer.

By placing an order in the Store, the Buyer confirms that they have read these Terms and agree to comply with them.

1. General provisions

1.1. These Terms apply to all purchases made in the Store.
1.2. The Seller reserves the right to modify or amend the Terms at any time by publishing the updated version on the Store’s website. The version valid at the time of order placement applies to that purchase.
1.3. The right to purchase in the Store is granted to legally capable individuals (aged 18 and over), legal entities, and their authorized representatives.

2. Formation of the contract

2.1. The purchase–sale contract is deemed concluded once the Buyer creates a shopping cart, provides delivery details, selects a payment method, confirms they have read the Terms, and clicks the “Confirm order” button.
2.2. Each contract between the Buyer and Seller is stored in the Seller’s database.

3. Buyer’s rights and obligations

The Buyer has the right to:

  • Purchase goods in accordance with these Terms;

  • Withdraw from the purchase–sale contract as provided by Lithuanian law;

  • Request replacement, repair, or refund for defective goods.

The Buyer undertakes to:

  • Provide accurate and truthful information when placing an order;

  • Accept and pay for the ordered goods as specified;

  • Not disclose login information to third parties (if an account is created).

4. Seller’s rights and obligations

The Seller has the right to:

  • Suspend or cancel order processing if the Buyer violates the Terms or provides incorrect information;

  • Temporarily or permanently terminate the Store’s operation with prior notice.

The Seller undertakes to:

  • Ensure technical access to the Store;

  • Provide clear and accurate product information;

  • Deliver ordered goods in accordance with these Terms;

  • Comply with Lithuanian consumer protection legislation.

5. Prices and payment

5.1. All prices in the Store are indicated in euros (EUR).
5.2. The Seller is not a VAT payer.
5.3. Payments can be made via the Paysera payment system or other methods indicated in the Store.
5.4. The order is considered final only after payment has been received.

6. Delivery

6.1. Goods are delivered via LP Express parcel terminals or other indicated methods.
6.2. Delivery times are specified for each product or in the order form.
6.3. Delivery costs are displayed separately before the final order confirmation.
6.4. The Buyer must collect the goods within the specified time. Uncollected goods are returned to the Seller.

7. Returns and withdrawal

7.1. A Buyer who is a consumer (natural person) has the right to withdraw from the contract within 14 calendar days of receiving the goods by notifying the Seller via email.
7.2. Returned goods must be unused, in original packaging, and with all labels attached.
7.3. Return shipping costs are covered by the Buyer unless the product is defective.
7.4. The Seller refunds the amount paid within 14 days of confirming the return, using the same payment method.
7.5. Custom-made or personalized items are non-returnable unless they are defective.

8. Liability

8.1. The Buyer is responsible for the accuracy of the information provided.
8.2. The Seller is not responsible for interruptions in third-party services (e.g., parcel terminal failures).
8.3. Both parties are released from liability for non-performance if caused by force majeure circumstances.

9. Personal data protection

9.1. The Buyer’s personal data are processed in accordance with the Privacy Policy, which the Buyer must review before making a purchase.
9.2. The data are used solely for order fulfillment and compliance with legal requirements.

10. Final provisions

10.1. Any disputes shall be resolved through negotiation. If an agreement cannot be reached, Lithuanian law shall apply.
